“If someone purchases duct tape in front of you in line at the store, you are not assuming it is being used for a crime,” he told Newsweek . “But if you first hear that someone committed a crime and then find out they purchased duct tape the day prior, your mind automatically jumps to premeditation.”
In Clancy’s case, he says jurors are hearing about behaviors that “could very well be consistent with a homicide or an episode of psychosis,” making the interpretation highly dependent on how each side frames the evidence.
Defense experts argue that organized behavior does not rule out severe psychiatric illness, especially postpartum psychosis, which can wax and wane rapidly. They point to Clancy’s months‑long deterioration, insomnia, medication changes, and documented fearfulness as signs she was experiencing a break from reality.
The jury must decide how “odd” behavior needs to be before it signals psychosis—and how much weight to give Clancy’s reported hallucination of a commanding male voice.
The trial has featured dueling psychiatric experts, each offering different interpretations of Clancy’s mental state. Some of her treating providers testified they did not observe psychosis in the weeks before the killings, while defense experts argue she was in the midst of a severe postpartum mental‑health crisis. Behl says jurors rarely choose an expert based on credentials alone. Instead, they gravitate toward the expert who communicates clearly, avoids jargon, and offers an explanation that accounts for all the evidence.
“If one expert is able to better avoid jargon and communicate to the jury in a way that helps them understand the opinion that was reached, that expert will typically be viewed as more credible,” he said.
