Add Page Six on Google WABC news anchor Liz Cho has filed a protective order to avoid testifying in her tumultuous divorce from ousted CBS host Josh Elliott .
Court papers obtained by Page Six show Cho filed a motion for a protective order on July 17 to stop Elliott's legal team from conducting a deposition of the "Eyewitness News" anchor scheduled for July 23, 2026.
"The deposition was noticed without any inquiry as to the availability of [Cho] and her counsel," Cho's request read.
She claimed her attorneys notified Elliott's legal team that "none of the attorneys on [Cho's] legal team are available on July 23rd due to previously scheduled conflicts" and "offered to coordinate a mutually convenient alternative date for the deposition and provided options for such alternative date."
Cho alleged Elliott's legal team did not respond to their request — with the office claiming counsel is "presently away on vacation."
The WABC anchor cited a procedure rule that allows the court to "enter any order that justice requires to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense, including an order that discovery be had only at a designated time or place or on specified terms and conditions."
Lawyers for Cho and Elliott did not respond to Page Six's requests for comment. Connecticut courts could not comment on whether the deposition took place or has been rescheduled.
Also in the protective order request, Cho objected to Elliott's legal team requesting she provide a series of documents, including "copies of any written correspondence, emails, cards, text messages, or any written forms of communication between you and any person, other than the Plaintiff, with whom you have or have had a romantic and/or sexual relationship from July 11, 2015 to June 23, 2025."
Despite Cho objecting to the specific request for production, Daily Mail reported she agreed to hand over any communications at a July 24 virtual court hearing.
The Connecticut judge on the case also ruled Cho must supply conversations in which she, or someone on her behalf, communicated with journalists about their divorce.
The judge also ruled Cho must also provide information on why she made a $500,000 transfer from their joint bank account to her teenage daughter's in October 2025. Cho and Elliott both have one daughter from previous relationships.
Page Six previously reported that Elliott, 55, filed for divorce from Cho, 55, on June 20, 2025, after nearly a decade of marriage.
The divorce has been tumultuous from the start, as Cho requested copies of Elliott’s communication with “any person … with whom [he] has or has had a romantic and/or sexual relationship, from July 11, 2015, to the present” — as well as any “communications in connection with [his] search for any employment," in a Nov. 6, 2025, court filing.
Then, in a Jan. 29 court filing, Cho claimed her estranged husband moved a “significant amount of furniture and furnishings” from their Connecticut home, including their two Portuguese water dogs.
She also claimed she was "missing a valuable watch and earrings from her jewelry bag" with the former CBS News anchor being “the only other person who had access to the missing watch and jewelry.”
An insider claimed to Page Six at the time that Elliott was the one to take care of the dogs and that he took “a small amount of furniture.”
Elliott denied his ex's claims in court papers, writing in his response, “[Elliott] did not ransack the marital home. … He removed limited personal property and furnishings so he would have a safe haven from [Cho’s] escalating and erratic behavior directed at not only [Elliott] but his minor child as well.”
He added in a separate filing, “[Elliott] removed only limited furniture items and furnishings, many from the basement, solely to furnish a new residence after removing himself and his child from a hostile environment created by [Cho].”
Elliott also denied her allegations regarding the jewelry.
In turn, he accused her in court documents of “monitoring and listening to [Elliott’s] private phone calls; rifling through [Elliott’s] personal belongings and closet; leaving the marital residence for extended periods without communication despite the presence of two dogs requiring daily care.”
Elliott also accused Cho in court documents of "lashing out" at him while he was "washing grapes for his daughter’s lunch, exclaiming that the grapes were hers and he was not permitted to put them in the child’s lunch.”
Also in the documents, he accused his ex of “locking doors and shutting off lights on [his] teenage daughter in the evening when it was 14 degrees outside.”
In a March 5 court filing, Cho accused Elliott of refusing to hand over financial and travel records .
Cho and Elliott met while working for ABC and tied the knot in July 2015 . This was the second marriage for both.
Elliott worked on ABC's "Good Morning America" from 2011 to 2014.
He had a brief stint with NBC before joining CBSN as lead daytime anchor in March 2016 — though he was let go from the company nearly a year later .
