Real estate attorney Benjamin Williams said many property owners believe they have been wrongly targeted as the city works to identify luxury second homes.
"Well, what people are really saying is, 'This is not fair. I shouldn't have to pay this,'" Williams said.
Williams said the city is placing the burden on homeowners to demonstrate that their properties qualify as primary residences.
"You're guilty until proven innocent. They're going to assume it's not a primary residence unless you can prove otherwise," he said.
Mayor Mamdani has maintained that the surcharge is intended to target wealthy property owners. In a City Hall video released earlier this year, he said:
"This pied-à-terre tax is specifically designed for the richest of the rich," Mamdani said earlier this year when the measure passed into law.
The city recently sent notices to 17,000 residents notifying them that they may owe the tax.
Mamdani later defended the administration's rollout of the program, saying property owners have time to work with the city before the surcharge takes effect.
"One of the reasons that this is being done now is to ensure that New Yorkers have requisite time before the implementation of the surcharge. They have until next March to be able to go back and forth with the Department to ensure that this is an accurate reflection," Mamdani said.
Williams criticized the process, arguing that homeowners are being asked to provide records the government already possesses.
"You have to now go and upload your income tax returns, your utility bills and, say, your driver's license, your voter records, which are mostly government records. The government already has that information," he said.
The Real Estate Board of New York, which opposed the tax, also raised concerns about its implementation.
"The administration was not prepared to start to roll out this complex tax and seek to administer it. And we're a little concerned it's not going to get much better in the continued implementation," said James Whelan, president of the Real Estate Board of New York.
Mamdani said two dozen staff members are being hired to help homeowners navigate the system. The Finance Department's deadline for filing exemption requests is Aug. 24, and the Tax Commission will hear appeals through March.
