On July 26, police in Ashburn, Virginia responded to a shooting at a home on the same block where Eric and Mia Bieniemy own a house, according to property records. In a statement to USA TODAY Sports, police said they found an adult woman who had been shot multiple times and took her to a nearby hospital. On July 27, Chiefs head coach Andy Reid told reporters that Mia Bieniemy was in stable condition and said Eric Bieniemy would temporarily step away from the team.
Elijah Bieniemy was arrested and transported to the Loudoun County Adult Detention Center where he was held without bond, police said. He is charged with malicious wounding, use of a firearm in commission of a felony (first offense) and discharge of a firearm inside of a dwelling.
According to Virginia law, Bieniemy could face up to 33 years in prison if found guilty on all three counts. The most severe charge is malicious wounding, a Class 3 felony punishable by a minimum of five years and maximum of 20 years in prison. Discharging a firearm inside of a dwelling is a Class 4 felony, which carries a prison sentence of 2-10 years. Each of those charges also carries a possible $100,000 fine.
Virginia criminal code defines malicious wounding as, "shoot, stab, cut, or wound any person or by any means cause him bodily injury, with the intent to maim, disfigure, disable, or kill."
If Bieniemy is convicted of using a firearm in commission of a felony, there is a mandatory minimum prison sentence of three years to be served consecutively with any punishment received for the primary felony.
According to online court records, Bieniemy was arraigned Monday morning and is scheduled to have a preliminary hearing on Aug. 31.
