(CNS) -- Orange County prosecutors have declined to file any criminal charges against the operators of a Garden Grove plastic manufacturing plant where a chemical leak forced mass evacuations earlier this year, but the company has agreed to establish a $100 million damages claim program for impacted residents and businesses, the District Attorney's Office announced on Monday.
The damages program is part of ongoing negotiations seeking to reach a civil settlement between GKN Aerospace Transparency Systems Inc. and the District Attorney's Office, which had been conducting a criminal investigation into the May leak and its aftermath. Prosecutors said the overall civil settlement will also likely include financial penalties, a safety plan for the plant's continued operation and reimbursement for the costs of first responders and other government agencies that responded to resolve the situation.
District Attorney Todd Spitzer announced in late May that his office was conducting a criminal investigation into the leak, which prompted the evacuation of roughly 13,000 to 17,000 households, or more than 50,000 people.
"After several months of investigation, which included onsite inspections, record review, and expert consultation, OCDA has concluded its criminal investigation and is now proceeding with negotiations toward a civil disposition with GKN," a Monday statement from the D.A.'s Office read.
Although local prosecutors have opted not to pursue any criminal charges, a federal investigation into the situation is believed to be ongoing. On June 10, federal authorities served a search warrant at the GKN plant . According to a search warrant affidavit, investigators were looking to seize any evidence of possible violations of federal requirements to prevent the "accidental release of extremely hazardous substance into the ambient air."
The OCDA noted that GKN Aerospace officials have been fully cooperating with county investigators.
The $100 million claims program announced Monday will be administered by an "independent third party not affiliated with GKN," according to the District Attorney's Office. The funds will be used to reimburse residents for expenses such as hotel stays and compensation for meals, transportation and loss of wages.
"I promised the residents of Orange County that I would do everything in my power to make the tens of thousands of residents who were forced from their homes due to this emergency whole," Spitzer said in a statement. "The community has an absolute expectation that businesses operating within their neighborhoods operate safely and lawfully, and I am pleased that GKN has been and continues to be responsive to any and all requests throughout this investigation."
"Through these settlement discussions, we are doing what is necessary to protect the community going forward while recognizing the emotional and financial suffering inflicted on families," he said. "This emergency showcased the best that Orange County has to offer in crisis management and it is through the leadership of the Orange County Fire Authority, the Garden Grove Police Department, and Supervisor Janet Nguyen who all worked tirelessly to protect lives that we are at a point now where we can focus on compensating all of those affected and look to the future of safe operations."
It was not immediately known how much GKN might be forced to pay through an eventual civil settlement.
In July, Orange County officials sent a letter to GKN demanding more than $4 million to cover the costs of county resources that were deployed when the situation began on May 21 at GKN's facility at 12122 Western Ave. Authorities said a problem with GKN's 34,000-gallon chemical storage tank cooling system caused a reaction of neutralized methyl methacrylate, or MMA , a toxic and highly flammable liquid used in the manufacture of acrylic plastics.
Authorities announced that the tank was in danger of exploding, prompting evacuations that affected residents and businesses in Garden Grove, the entire city of Stanton and other nearby communities, with the situation lingering for nearly a week, including the Memorial Day weekend.
Ultimately, a crack in the damaged tank relieved the pressure inside the tank and negated the explosion risk.
According to Spitzer's office, GKN plans to resume manufacturing operations at the plant on Sept. 28, "contingent upon full compliance with required safety standards, ongoing monitoring protocols, any regulatory obligations and a court-approved safety plan."
Nguyen issued a statement Monday saying she was "excited" to learn of the $100 million damages fund being established for residents and businesses.
"I'm glad that GKN is stepping up and providing this much-needed relief," she said. "They have been part of the community for decades and employ a large local workforce with good-paying jobs. All along, I have said my goal is to make the community whole. I urge everyone who lost money to apply for this relief."
Details were not immediately released on how residents and businesses can apply for the damages fund.
